A man Kywan Fisher downloaded 10 of Flava Works’ porno movies which in of itself isn’t a bad thing. He went wrong when he hooked them up to BitTorrent. He was ordered by the court to shell out a cool $1.5 million (usd) for the priviledge. This is the largest damages awarded in one of the few piracy cases that actually found it’s way to court!

Fisher was a paying member to Flava Works’ website and legitimately downloaded the 10 videos which he apparently enjoyed so much he decided they were too good not to share and so he did. What he did not know was that Flava Works embeds it’s video files with the username and other key tag identifying information from those members who download them allowing them to immediately track back to who posts them. Too bad for Fisher!

Flava Works had stone cold evidence to support their case without question, not to mention that when Fisher signed up part of the TOS was that he would not redistribute materials from the site. This made it an open and shut case for the Flava legal team! Considering that the videos were only downloaded 3,500 times that’s around $470.00 for each of the downloads. I sure hope that it was worth doing!

The LA Times Blog reported today that a new city ordinance requiring porn actors to wear condoms during filming takes effect Monday.

The Los Angeles City Council approved the ordinance in January, following several high-profile instances of porn performers becoming infected by HIV. The Los Angeles-based AIDS Healthcare Foundation has been advocating for the public health measure for years.

The ordinance is believed to be the first of its kind. It requires adult film producers, when seeking a filming permit in the city of Los Angeles, to have actors use condoms. The porn production companies, which are largely based in the San Fernando Valley, opposed the ordinance.

Although the new law becomes official Monday, the city is still ironing out details on its implementation.

The AIDS Healthcare Foundation is now collecting signatures for a countywide initiative, said President Michael Weinstein. “This is definitely a milestone in this long battle for safety in adult films, but we still have a long way to go,” he said.

This is some of the most ridiculous action taken ever. First the AIDS Healthcare Foundation destroys the industries first line of defense AIM (Adult Industry Medical) which for years provided STD testing to the adult industry that was vastly superior to what you local doctor does, and then cry about safety in the industry. What’s even sadder is how this law has been passed yet no one has any idea how to actually implement it.

This is yet another example of the rebirth of the moral majority and has absolutely nothing to do with safety. The underlying intent is nothing more than to harm the industry financially and force it out of business. Unfortunately these people aren’t smart enough to realize that the industry doesn’t have to pull permits to shoot on private property and 2. doesn’t have to shoot in the city or county of Los Angeles.
